Quick answer: A registered rent agreement is a rental contract that has been stamped and then recorded with the Sub-Registrar under the Registration Act, 1908. Registration is compulsory for any lease of more than one year, for a year-to-year lease, or one that reserves a yearly rent. Shorter agreements can be registered voluntarily, and in Maharashtra and Tamil Nadu every tenancy must be registered.

Most people in India sign an 11-month agreement on ₹100 stamp paper and never think about registration again. That works, until the day you need the agreement to do real work: a passport application, an Aadhaar address update, a court case over the deposit, or a lease that runs three years instead of eleven months. Then the difference between "stamped" and "registered" stops being a technicality.

This guide covers what registration actually changes, when the law forces it, what it costs, and how the process runs in practice.

What is a registered rent agreement?

A registered rent agreement is one that has passed through two separate steps:

  1. Stamping. The agreement is printed on (or attached to) stamp paper or an e-stamp certificate of the correct value under your state's Stamp Act.

  2. Registration. Landlord and tenant (or their authorised representatives) present the stamped agreement before the Sub-Registrar of the area where the property sits. The Sub-Registrar records it, takes photographs and thumb impressions or biometrics, collects the registration fee, and returns the document with a registration number and endorsement.

A notarised agreement stops after step one plus a notary's seal. The notary confirms who signed. The notary does not put the agreement on any government record. We compare the two in detail in our guide to online vs notarised rent agreements.

When is registration mandatory?

Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases of immovable property:

  • from year to year, or

  • for any term exceeding one year, or

  • reserving a yearly rent.

That single rule explains the 11-month agreement. Keep the term at eleven months, and Section 17 doesn't bite. Write "two years", and the agreement must be registered.

Two state laws go further and require registration regardless of term:

State
Law
What it saysMaharashtra | Section 55, Maharashtra Rent Control Act, 1999 | Every leave and licence or tenancy agreement must be in writing and registered. The landlord carries the responsibility.
Tamil Nadu | Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 | Tenancy agreements must be registered with the Rent Authority (online at tenancy.tn.gov.in) within 90 days of execution.

If you rent in Mumbai, Pune or Chennai, "I'll just do an 11-month agreement" does not get you out of registration.

What happens if a compulsory agreement isn't registered?

Section 49 of the Registration Act says an unregistered document that should have been registered cannot be used as evidence of the lease itself. The court may still look at it for a "collateral purpose", for example to show the nature of possession, but you lose the comfort of a clean, enforceable contract.

Picture it. You signed a three-year agreement in Gurugram with a lock-in of 24 months, and you never registered it. In month eight, the landlord wants you out. You point to the lock-in clause. The landlord's lawyer points to Section 49. Your strongest clause is now the one you can't rely on.

There's a stamp duty problem too. Section 35 of the Indian Stamp Act, 1899 (and the matching sections of state Stamp Acts) bars an insufficiently stamped document from evidence until the deficit is paid with a penalty. Registration forces correct stamping up front, because the Sub-Registrar won't accept an under-stamped document. Create Now!

Registered vs unregistered: what actually changes

Point
Unregistered (11-month, stamped or notarised)
RegisteredGovernment record | None | Recorded with the Sub-Registrar; certified copies available
Evidence in court | Admissible if properly stamped and the term doesn't need registration | Strong documentary evidence
Passport address proof | Not accepted | Accepted (MEA circular, corrigendum of June 2015)
Aadhaar address update | Not on UIDAI's list | Registered rent/lease agreement is listed as proof of address
Cost | Stamp paper only | Stamp duty + registration fee + travel or service charges
Effort | Sign and done | Both parties (or a power-of-attorney holder) present before the Sub-Registrar, unless the state allows online e-registration

How much does registration cost?

Two charges stack up: stamp duty and the registration fee. Both are set state by state, and both change. Treat the figures below as the structure, then confirm the current amount on your state's official stamp duty calculator before you pay.

State
Typical basis (verify before paying)Delhi | Stamp duty on a percentage of average annual rent for longer terms; registration fee commonly quoted at ₹1,100
Maharashtra | 0.25% of total rent plus deposit-linked notional interest; registration fee ₹1,000 (municipal areas) or ₹500 (rural)
Uttar Pradesh | Fixed slabs by annual rent and tenure for agreements up to 10 years, after the 2025 revision that cut charges by up to 90%
Karnataka | Percentage of annual rent plus advance, with a cap for short terms

Our separate guide on stamp paper for rent agreements has the state-wise detail and how to buy an e-stamp online.

A worked example from Maharashtra, using the formula the IGR applies: rent of ₹25,000 a month for 24 months is ₹6,00,000. A refundable deposit of ₹5,00,000 adds notional interest of 10% a year, so ₹1,00,000 over two years. Total ₹7,00,000. Stamp duty at 0.25% is ₹1,750. Add ₹1,000 registration in Mumbai.

How to register a rent agreement: step by step

  1. Draft the agreement. Names and addresses of both parties, property description, rent, deposit, term, lock-in, maintenance, notice period, and the use (residential or commercial). If you use Law At Ease's rent agreement tool, the draft is generated from one form and you can review it before paying.

What goes wrong: a property description that doesn't match the title documents. The Sub-Registrar may refuse it.

  1. Pay stamp duty. Buy an e-stamp certificate of the right value (through SHCIL or your state's e-stamping or GRAS portal) or pay online as part of e-registration.

What goes wrong: paying the 11-month value on a 3-year agreement. The document is then under-stamped.

  1. Book a slot at the Sub-Registrar office. Most states run online appointment booking through their registration portals (IGR Maharashtra, Kaveri in Karnataka, IGRS in UP and others).

  2. Attend with documents. Both parties (or a holder of a registered power of attorney), two witnesses, original ID proofs, the landlord's ownership proof, passport photos, and the stamped agreement.

  3. Biometrics and signing. Photographs and thumb impressions are captured; the Sub-Registrar checks identities and the stamp.

  4. Collect the registered copy. You get the endorsed original back, usually the same day or within a few days. Keep a scan.

Section 23 of the Registration Act gives you four months from the date of execution to present the document. Don't sit on it. Rent revisions and disputes are much easier with a registered copy in hand.

Can you register a rent agreement online?

Partly, and it depends on the state.

  • Maharashtra runs a fully online leave and licence registration for Mumbai City and Mumbai Suburban (Leave and Licence 2.0 on the IGR portal), using Aadhaar-based biometric authentication, plus e-registration elsewhere. Nobody has to visit the Sub-Registrar.

  • Tamil Nadu lets you register tenancies with the Rent Authority online at tenancy.tn.gov.in.

  • Most other states let you draft, pay stamp duty and book an appointment online, but still require a physical visit for biometrics.

So "online registration" usually means "online paperwork plus one short office visit". Anyone promising a fully remote registered agreement in Delhi or Karnataka should be able to explain exactly which portal they use.

Should you register an 11-month agreement anyway?

You don't have to, but there are three good reasons to consider it: you need passport or Aadhaar address proof, the deposit is large (common in Bengaluru, where 6–10 months is still asked for), or the relationship with the landlord is already shaky. For a straightforward 11-month flat rental where neither side needs address proof, a properly stamped and signed agreement, ideally with Aadhaar eSign so identities are verified, is usually enough.

Frequently asked questions

1. What is a registered rent agreement?

It's a rent agreement that has been stamped under the state Stamp Act and then recorded with the Sub-Registrar under the Registration Act, 1908. The registered copy carries an official endorsement and number, and certified copies can be obtained later from the registration office.

2. Is it mandatory to register an 11-month rent agreement?

Not under the Registration Act, which applies to leases exceeding one year, year-to-year leases or leases reserving a yearly rent. But Maharashtra and Tamil Nadu require registration for all tenancies, whatever the term.

3. What happens if I don't register a rent agreement that needed registration?

Under Section 49 of the Registration Act, the court won't accept it as evidence of the lease terms. It may only be used for collateral purposes. Clauses such as lock-in or rent escalation become hard to enforce.

4. How much does it cost to register a rent agreement?

You pay stamp duty plus a registration fee, both set by the state. In Maharashtra, for example, stamp duty is 0.25% of total rent and notional deposit interest, and the registration fee is ₹1,000 in municipal areas. Always confirm on your state's official calculator.

5. Can I register a rent agreement online?

Fully online registration is available for leave and licence agreements in parts of Maharashtra, and Tamil Nadu lets tenancies be registered with the Rent Authority online. Most other states allow online drafting, payment and appointment booking but still need one office visit.

6. Who should pay for rent agreement registration?

The law doesn't fix it. It's a matter of agreement between landlord and tenant. In practice, the cost is often split equally, and the agreement should state who pays.

7. Do both landlord and tenant have to be present for registration?

Yes, unless one of them is represented by a holder of a registered power of attorney, or the state's online system lets each party authenticate remotely.

8. Is a registered rent agreement valid as address proof for a passport?

Yes. The Ministry of External Affairs accepts a registered rent agreement as proof of address, following a corrigendum issued in June 2015. Notarised agreements are not accepted for this purpose.

9. How long does registration take?

Once the appointment is booked and documents are in order, the office process usually takes under an hour. The registered copy is often handed back the same day.

10. Is there a time limit for registering a rent agreement after signing?

Yes. Section 23 of the Registration Act requires the document to be presented within four months of execution. Tamil Nadu's tenancy law sets 90 days for registration with the Rent Authority.
