Security Deposit Rules in India
Quick answer: Most of India has no statutory cap on rental security deposits; the amount is whatever the agreement says. Tamil Nadu caps it at three months' rent, and the Model Tenancy Act proposes two months for homes and six for commercial premises in states that adopt it. The deposit must be refunded at move-out, minus unpaid rent, bills and damage beyond normal wear and tear.

The deposit is the single biggest source of landlord–tenant disputes in Indian cities. It's also the most avoidable. Most withheld-deposit fights trace back to one of two gaps: an agreement that says nothing about deductions, or no record of the flat's condition on day one.

How much security deposit can a landlord ask for?

There's no national limit. The Transfer of Property Act, 1882, which governs most leases, says nothing about deposits, so the agreement decides. Two exceptions:

Where
CapTamil Nadu (2017 tenancy law) | Three months' rent
States adopting the Model Tenancy Act | Two months' rent (residential), six months' (non-residential)

Without a cap, market practice fills the gap. In Delhi NCR, one to two months is typical. Mumbai and Pune commonly see three to six months. Bengaluru has long been the outlier, where deposits of six to ten months were routine, though competitive markets have pushed many landlords lower.

The Model Tenancy Act explainer covers whether your state has adopted the cap.

What is a "heavy deposit" flat?

A heavy-deposit arrangement, common in Mumbai and Pune, swaps monthly rent for one large refundable deposit. The tenant might pay ₹15 lakh upfront and little or no rent for 11 to 36 months. The landlord gets a lump sum to invest or repay a loan; the tenant saves on monthly outgo.

It carries real risk for the tenant. If the landlord can't repay at the end, you're chasing a large sum through the courts. Three precautions:

  1. Register the agreement. In Maharashtra it's compulsory anyway under Section 55 of the Maharashtra Rent Control Act, 1999; stamp duty there is calculated on a notional 10% annual interest on the deposit. See our leave and licence guide.

  2. Check for loans on the property. A flat mortgaged to a bank can be sold under the SARFAESI Act if the owner defaults, and your tenancy may not survive it.

  3. Add a refund-default clause. Interest at a stated rate on late refund, and the right to stay on without rent until repayment.

When must the deposit be refunded?

When the tenancy ends and possession is handed back. The agreement should fix the period; seven to fifteen days is a fair window for a final inspection and bill settlement. Tamil Nadu's law requires refund within one month of vacating. Where the agreement and state law are both silent, a court will treat refund as due on handover, and unreasonable delay attracts interest.

What can a landlord deduct?

Lawful deductions
Not lawful (usually)Unpaid rent up to the handover date | Normal wear and tear: faded paint, minor scuffs, ageing fixtures
Unpaid electricity, water, gas and maintenance bills | Repainting the whole flat as routine
Repair of damage beyond normal use (broken tiles, holes in walls, damaged appliances) | Repairs the landlord was responsible for anyway (structural, seepage)
Rent in lieu of notice, if the tenant left without the agreed notice | Lock-in penalty not mentioned in the agreement
Agreed charges in the agreement (deep cleaning, if specified) | Arbitrary "admin" or "brokerage" deductions

"Painting charges" deserve a special mention. If the agreement says the tenant pays for repainting at move-out, it's enforceable. If it doesn't, the landlord can't invent it. Landlords should say so upfront; tenants should read it before signing.

How to protect your deposit from day one

For tenants:

  • Pay the deposit by bank transfer, never cash, and mention "security deposit" in the transfer note.

  • Make sure the agreement states the amount, the refund period and the permitted deductions.

  • On move-in, take date-stamped photos and a short video of every room, and email them to the landlord. That email is your evidence.

  • Make an inventory list (fans, lights, geyser, AC, furniture) signed by both.

For landlords:

  • State deductions clearly, including painting or cleaning if you intend to charge for it.

  • Do a joint inspection on the last day and record readings.

  • Return the undisputed portion promptly even if part is in dispute.

A deposit clause that holds up

Most deposit fights come down to vague wording. Here's sample language you can adapt (have an advocate check it against your state's law):

"The Tenant has paid the Landlord a refundable, interest-free security deposit of ₹[amount] by bank transfer dated [date]. The Landlord shall refund the deposit within [15] days of the Tenant handing over vacant possession and keys, after deducting only: (a) unpaid rent up to the handover date; (b) unpaid electricity, water, gas and maintenance charges, against bills; and (c) the reasonable cost of repairing damage beyond normal wear and tear, supported by an itemised estimate or invoice shared with the Tenant. If the Landlord fails to refund within the said period, the outstanding amount shall carry simple interest at [12]% per annum until paid."

Three things make it work. The deductions are a closed list, so nothing can be added later. Each deduction needs a bill or estimate, so it can be checked. And the interest clause gives the landlord a reason to pay on time.

Move-out checklist

Before you hand over the keys:

  1. Ask the landlord, in writing, for a joint inspection date.

  2. Clear all utility bills and get final meter readings photographed.

  3. Clean the flat and take a fresh set of date-stamped photos and video, room by room, matching your move-in set.

  4. Return every key and access card against a written acknowledgement.

  5. Send an email the same day listing the handover time, the meter readings, your bank details and the refund deadline from the agreement.

That email becomes the first page of your evidence if the refund doesn't arrive.

How to recover a withheld deposit

  1. Ask in writing. Send an email or WhatsApp message with your bank details and the handover date. Many delays end here.

  2. Send a legal notice. A notice from an advocate setting out the agreement, the payment proof and a 15-day deadline is often decisive. Our guide to drafting a legal notice explains the structure, or you can have a Law At Ease advocate send the notice for you.

  3. Try pre-litigation settlement. District Legal Services Authorities run Lok Adalats and mediation, which are free and quick for small money claims.

  4. File a civil suit for recovery. Money claims generally have a three-year limitation period under the Limitation Act, 1963, counted from when the refund became due. A summary suit under Order XXXVII of the Code of Civil Procedure may be available where the claim is a liquidated sum under a written contract.

  5. Use the Rent Authority in states that have set one up under their tenancy law.

The Consumer Commission is usually the wrong forum. A private landlord isn't providing a "service" to you under the Consumer Protection Act, 2019, though disputes with a professional rental company may be different.

Deposits for shops and offices

Commercial deposits follow the same basic law but run larger. Three to six months' rent is common, and big-ticket commercial leases sometimes ask for more, along with a separate fit-out or interior deposit. The Model Tenancy Act's proposed cap for non-residential premises is six months.

The extra risks are about time. Commercial leases often run for years, so the deposit may sit with the landlord for a long period. Negotiate a clause on what happens if the property is sold (the buyer should take over the deposit liability), require the deposit refund to be a condition of handover, and register the lease so the deposit figure is on record. A bank guarantee in place of a cash deposit is worth asking for on large leases. Contact Us!

Is the deposit taxable for the landlord?

A genuinely refundable deposit is a liability, not income, so it isn't taxed as rent when received. Non-refundable portions, or deposits adjusted against rent, are treated as rental income. Ask your tax adviser how this applies to your case.

Frequently asked questions

Marked up with FAQPage schema so answers can appear directly in search results.

Is there a legal limit on security deposits in India?

Not nationally. Tamil Nadu caps deposits at three months' rent, and the Model Tenancy Act proposes two months for homes and six for commercial premises in states that adopt it. Elsewhere, the agreement decides.

How many days does a landlord have to return the security deposit?

As many as the agreement specifies. Tamil Nadu requires refund within one month of vacating. Where nothing is specified, refund is due on handover, and delay may attract interest.

Can a landlord deduct painting charges from the deposit?

Only if the agreement says so, or if the walls are damaged beyond normal wear and tear. Routine repainting isn't a lawful deduction without an agreed clause.

What can I do if my landlord doesn't return my deposit?

Demand it in writing, then send a legal notice. If that fails, file a civil suit for recovery within three years, or approach the Rent Authority where your state has one.

Can I file a consumer complaint for my security deposit?

Usually not against a private individual landlord, who isn't providing a service under the Consumer Protection Act. A civil suit is the normal route.

Can a tenant adjust the deposit against the last month's rent?

Only if the agreement or the landlord allows it. Doing it unilaterally is technically non-payment of rent, though many landlords accept it in practice.

What is a heavy deposit flat?

An arrangement, common in Mumbai and Pune, where the tenant pays a large refundable deposit in place of most or all monthly rent. It should always be registered and checked for loans on the property.

Does the landlord have to pay interest on the security deposit?

Not unless the agreement or state law provides for it. A court may award interest if the refund is wrongfully delayed.

Should I pay the security deposit in cash?

No. Pay by bank transfer and label it as a security deposit, so you have proof of payment if there's a dispute later.

Is the security deposit taxable for the landlord?

A refundable deposit isn't taxed as income when received. Non-refundable portions, or amounts adjusted against rent, are treated as rental income.
