Rent Receipt for HRA
Quick answer: A house rent receipt for HRA must show the tenant's and landlord's names, the rented property's address, the rent amount, the period covered, the payment date and mode, and the landlord's signature. If your annual rent exceeds ₹1 lakh, your employer also needs the landlord's PAN. Cash receipts above ₹5,000 should carry a ₹1 revenue stamp. HRA exemption is available only if you're in the old tax regime.

Every January, payroll teams send the same email: submit rent receipts for HRA by the 15th. And every January, people scramble to produce twelve receipts for a year of rent, often signed in one sitting. That's usually fine. What isn't fine is a receipt that doesn't match your bank records, names a landlord without the right PAN, or claims rent paid to someone who doesn't own the flat.

Who can claim HRA?

House Rent Allowance is part of salary for many employees. The exemption on it (Section 10(13A) of the Income-tax Act, 1961, read with Rule 2A, for tax years up to 2025-26) is available if:

  • you receive HRA as part of your salary,

  • you actually pay rent for accommodation you live in,

  • you don't own the house you live in (owning a house in another city is allowed), and

  • you've opted for the old tax regime. The new regime, which became the default from 2023-24, doesn't allow the HRA exemption.

From 1 April 2026, the Income-tax Act, 2025 replaces the 1961 Act with renumbered provisions. Ask your employer or tax adviser which provisions and forms apply for your tax year.

How much HRA is exempt?

The exempt amount is the lowest of three figures:

  1. The actual HRA you received.

  2. Rent paid minus 10% of salary (basic plus dearness allowance).

  3. 50% of salary if you live in Delhi, Mumbai, Kolkata or Chennai; 40% elsewhere.

Example. You live in Bengaluru. Basic salary is ₹60,000 a month (₹7,20,000 a year), HRA is ₹24,000 a month (₹2,88,000 a year), and rent is ₹25,000 a month (₹3,00,000 a year).

Test
AmountActual HRA received | ₹2,88,000
Rent minus 10% of salary (₹3,00,000 − ₹72,000) | ₹2,28,000
40% of salary (non-metro under these rules) | ₹2,88,000
Exempt HRA (lowest) | ₹2,28,000

The remaining ₹60,000 of HRA is taxable.

The ₹1 lakh landlord PAN rule

If the rent you pay to a landlord exceeds ₹1 lakh in a financial year (more than about ₹8,333 a month), you must give your employer the landlord's PAN. It's collected through Form 12BB along with the landlord's name and address.

What if the landlord doesn't have a PAN? Employers typically accept a signed declaration from the landlord stating they don't hold one, with their name and address. What doesn't work is entering someone else's PAN or a made-up number. PAN-based data matching means the tax department can see whether the landlord reported the rent as income.

The limit applies per landlord. If two co-owners each receive under ₹1 lakh, neither PAN is strictly required, though many employers ask anyway.

Revenue stamp on cash rent receipts

Receipts for cash payments above ₹5,000 should carry a ₹1 revenue stamp, signed across by the landlord, under the Indian Stamp Act. Payments by bank transfer, UPI or cheque don't need one, because the bank record is the proof. Pay digitally wherever you can; it makes the receipt almost a formality.

Do you need a rent agreement to claim HRA?

The law doesn't specifically require one, and many employers accept receipts alone up to a threshold. But a rent agreement is the strongest supporting document if an assessing officer asks for proof, especially for large claims. It shows the rent, the address and that the arrangement is genuine. You can create a rent agreement online on Law At Ease with digital stamp and Aadhaar eSign in about ten minutes.

Paying rent to your parents

This is legal and common. You can pay rent to a parent who owns the house you live in and claim HRA, provided:

  • the parent actually owns the property,

  • rent is actually paid (ideally by bank transfer, every month),

  • the parent shows it as rental income in their tax return, and

  • there's a rent agreement and receipts.

Rent paid to a spouse is treated with much more suspicion and is generally not accepted, because the arrangement looks like a transfer within the household.

HRA when you share a flat

Sharing a flat is the norm for young professionals in Bengaluru, Pune, Gurugram and Hyderabad, and it complicates HRA only slightly.

Each flatmate can claim HRA on their own share of the rent, not the full rent. If three of you pay ₹45,000 in total and you pay ₹15,000 by transfer to the landlord each month, your receipts should show ₹15,000 received from you. Three things keep it clean:

  • Pay your share directly to the landlord, not to the flatmate whose name is on the agreement. A trail of transfers to a friend looks like a personal loan, not rent.

  • Get the landlord to issue separate receipts to each flatmate for their share.

  • Get your name on the agreement. If only one person signed, ask the landlord to add the others or sign a short acknowledgement naming all occupants and their shares. Our post on two tenants sharing one rent agreement explains how.

HRA and a home loan at the same time

You can claim both HRA exemption and home loan benefits in the same year in some situations, which surprises many people. The common legitimate case: you own a flat in one city (perhaps let out, or under construction) and work and rent in another. The rules on interest deductions differ for self-occupied and let-out property and have changed between tax years, so get your CA to check the combination for your year.

What draws scrutiny is claiming HRA for a flat in the same city where you claim your own house as self-occupied. Unless there's a genuine reason (the owned flat is too far from work, or too small for the family), expect questions.

TDS if your rent is high

If you're an individual paying rent above ₹50,000 a month, Section 194-IB of the Income-tax Act, 1961 requires you to deduct TDS on the rent and deposit it, using Form 26QC. The rate was reduced to 2% from 1 October 2024. Most salaried tenants don't know this rule exists until they get a notice. Confirm the current rate and provision for your tax year.

Landlord's address: [____]

[Affix ₹1 revenue stamp if paid in cash and amount exceeds ₹5,000]

Generate twelve copies, one per month, and keep them with your bank statements. If the landlord won't sign receipts at all, the bank or UPI record and the rent agreement are your fallback evidence; see our guide to tenant rights.

Paying rent in cash

Cash rent is still common with older landlords, and it's legal. It just puts more weight on the paperwork. If you pay in cash:

  • get a signed receipt every month, with a ₹1 revenue stamp once the amount crosses ₹5,000,

  • withdraw the cash from your own bank account around the same date each month, so your statement shows a matching pattern,

  • keep the rent agreement handy, because it's the one document that ties the cash to the tenancy.

Large cash HRA claims with no withdrawals to match are exactly the pattern that draws a notice. Moving to UPI, even for part of the rent, removes the problem. Contact Us!

Mistakes that trigger questions

  • Receipts showing cash payments when your bank statement shows regular transfers to someone else.

  • Rent amounts that change mid-year without a revised agreement.

  • A landlord PAN that belongs to someone who isn't the owner.

  • Claiming HRA for a city where you also claim interest on a self-occupied home loan for a house you live in.

  • Submitting receipts for months before you moved in.

Marked up with FAQPage schema so answers can appear directly in search results.

What details are needed on a rent receipt for HRA?

Tenant and landlord names, property address, rent amount, period, payment date and mode, the landlord's signature, and the landlord's PAN if annual rent exceeds ₹1 lakh.

Is landlord PAN mandatory for HRA?

Yes, if the rent paid to that landlord exceeds ₹1 lakh in the financial year. Below that, it isn't strictly required.

Is a revenue stamp required on rent receipts?

Only for cash payments above ₹5,000. Receipts for bank, UPI or cheque payments don't need one.

Can I claim HRA without a rent agreement?

Often yes, with receipts, but a rent agreement is strong supporting evidence if the tax department questions the claim.

Can I pay rent to my parents and claim HRA?

Yes, if your parent owns the house, the rent is actually paid, and your parent declares it as income. Keep an agreement and bank records.

Can I claim HRA under the new tax regime?

No. The HRA exemption is available only under the old tax regime.

Can I claim HRA if I own a house in another city?

Yes. Owning a house in a different city from where you live and pay rent doesn't stop the HRA exemption.

What if my landlord refuses to give rent receipts?

Use bank or UPI records and your rent agreement as proof. A written request, and if needed a legal notice, can also be used to obtain receipts.

Do I need monthly rent receipts?

Monthly receipts are standard, but many employers accept quarterly or annual receipts that clearly cover each month.

Is TDS required on house rent?

If you're an individual paying more than ₹50,000 a month in rent, Section 194-IB requires TDS, currently at 2% after the October 2024 change. Check the current provision for your tax year.
