Rent Agreement as Address Proof
Quick answer: A rent agreement is accepted as address proof for a passport only if it's registered; the Ministry of External Affairs confirmed this in a 2015 corrigendum. A registered rent or lease agreement also appears on the lists for Aadhaar and voter ID updates. For GST and company registration, a rent agreement plus the owner's ownership proof (and often an NOC) is standard. For bank KYC, a private rent agreement isn't an officially valid document.

You move to a new city, sign an 11-month agreement on ₹100 stamp paper, and three months later apply for a passport. The application asks for proof of your present address. You upload the agreement. It gets rejected. Nothing was wrong with the agreement as a tenancy document. It just wasn't the kind of document the passport office accepts.

The rule of thumb is simple: the more official the purpose, the more likely you need a registered agreement.

Where a rent agreement works, and what kind

Purpose
Accepted?
What you needPassport | Yes, if registered | Registered rent agreement executed by the landlord in your favour
Aadhaar address update | Yes, if registered | Registered sale/lease/rent agreement is on UIDAI's list of proof-of-address documents
Voter ID (shifting or new enrolment) | Yes, if registered | The Election Commission's address-proof list includes a registered rent lease deed for tenants
Bank account KYC | Generally no, on its own | An officially valid document (passport, Aadhaar, driving licence, voter ID and a few others) with your current address
GST registration (rented premises) | Yes | Rent or lease agreement plus a document proving the landlord's ownership (property tax receipt, municipal khata or electricity bill)
Company / LLP registered office | Yes | Rent agreement, the owner's NOC, and a recent utility bill
Gas connection, school admission, employer records | Usually yes | A stamped (often notarised) agreement is commonly accepted; check with the provider

Rent agreement for passport

The Ministry of External Affairs issued a circular on 30 July 2014 accepting registered rent agreements as proof of address, and a corrigendum in June 2015 removed the condition that the agreement must run for over a year. The current position: a registered rent agreement, executed by the landlord in favour of the applicant, may be accepted as valid proof of address, and passport authorities won't question the agreement's term.

Two consequences:

  • A notarised agreement won't work. Notarisation isn't registration. If you plan to apply for a passport in your rented city, register the agreement, even if it's for 11 months.

  • The agreement must name you. If your spouse or flatmate is the tenant and you aren't on the agreement, it isn't your address proof. Get yourself added.

If your agreement isn't registered and you need a passport soon, other address proofs may be quicker: a bank passbook with photograph, a utility bill in your name, or your spouse's passport with the same address. Our registered rent agreement guide covers how to register, including states where it can be done largely online.

Aadhaar and voter ID

UIDAI's list of supporting documents for address includes a registered sale, lease or rent agreement. A notarised agreement isn't on the list, so the same logic as the passport applies. If your Aadhaar address doesn't match the rented flat at the time you make the agreement, that's a separate issue covered in our post on rent agreements with a different Aadhaar address.

For voter ID, the Election Commission's address-proof list for Form 6 (new enrolment) and Form 8 (shifting) includes a registered rent lease deed for tenants, alongside documents like utility bills and bank passbooks.

Bank accounts and KYC

Here's where people get caught out. Under the RBI's Master Direction on KYC, banks verify address through "officially valid documents": passport, driving licence, proof of possession of Aadhaar, voter ID, NREGA job card and the NPR letter. Where your OVD doesn't show your current address, banks can accept certain "deemed" documents, such as a recent utility bill or property tax receipt, on condition you submit an updated OVD within three months.

A private rent agreement isn't on either list. Some banks may take it as supplementary evidence, but don't count on it. The quickest path is usually updating the address on your Aadhaar using a registered agreement, then using Aadhaar for bank KYC.

GST registration: rent agreement and NOC from the owner

If you're registering a business at rented premises, the GST portal asks for proof of the principal place of business. For rented or leased premises, the standard set is:

  1. a copy of the valid rent or lease agreement, and

  2. any document showing the landlord owns the premises: latest property tax receipt, municipal khata copy or electricity bill.

Where there's no formal agreement (for example, you're using a relative's shop), a consent letter or NOC from the owner plus the owner's ownership proof and ID is used instead. A home-based business run from a rented flat needs the landlord's consent too, because the GST officer may verify the premises physically.

A practical point: many residential agreements say "for residential use only". If you register a business at that address, you're arguably in breach. Get a short NOC from the landlord permitting use of the address for GST registration, and keep it with the agreement. Law At Ease advocates can draft the NOC along with your agreement.

Company and LLP registered office

For a company or LLP registered office at rented premises, the Ministry of Corporate Affairs filings typically require the rent agreement, an NOC from the owner permitting use as a registered office, and a utility bill not older than two months. As with GST, a commercial-use NOC removes any argument about a residential-only clause.

What makes an agreement acceptable as address proof

Whatever the office, officials look for the same handful of things. Check your agreement against this list before you submit it:

  • Your name appears as a tenant, spelt as on your ID. "Priya S." on the agreement and "Priya Sharma" on the passport form invites a query.

  • The address is complete: flat number, floor, building, street, locality, city and PIN code, matching the utility bills for the property.

  • The landlord is the owner, or the agreement records their authority to let. Officials sometimes cross-check with a property tax receipt or electricity bill.

  • The agreement is current. An expired agreement, or one that expires next month, may be refused. Renew before you apply.

  • It's correctly stamped, and registered where the purpose requires it (passport, Aadhaar, voter ID).

  • You have a clean copy. Registered agreements come back with the Sub-Registrar's endorsement; scan every page, including the endorsement page, in colour.

Getting these right first time saves a second appointment, which for a passport can mean weeks. Carry the original registered agreement to any in-person verification as well, even if you uploaded a scan; officers routinely ask to see it, and a missing original is one of the most common reasons an appointment ends without approval.

Need a passport soon? A practical route

If you're renting on an unregistered agreement and need address proof quickly, here's the order that usually works:

  1. Check whether you already have another accepted proof for the current address: a bank passbook with photograph, a utility bill in your name, or a family member's passport at the same address. Using one of these avoids re-executing the agreement.

  2. If not, re-execute the agreement as a registered document. Draft a fresh agreement (or a supplementary one) for the remaining term, pay the correct stamp duty, and book a Sub-Registrar appointment. Both parties attend, or one through a registered power of attorney.

  3. Update Aadhaar first, then the passport. Once Aadhaar shows your new address, it becomes proof for almost everything else, including bank KYC.

Students and PG residents face a different problem: PG arrangements are usually licences without a registered document. A bonafide certificate from your college, or a letter from your employer on letterhead, is often accepted for some purposes, though not for a passport. For the passport, check the current list on the Passport Seva portal for your category.

Notarised vs registered: why it keeps coming up

Every row in the table above that says "registered" exists because a government record backs the document. A notary only confirms who signed. That's the core difference we explain in online vs notarised rent agreements. If you know you'll need the agreement for a passport, Aadhaar or voter ID, plan for registration from the start rather than redoing the agreement later.

For short tenancies where you only need proof for an employer, school or gas agency, a correctly stamped agreement signed with Aadhaar eSign through Law At Ease's online rent agreement is usually enough.
